Registration - Agreement

It is important that the privacy of any children who use the Yourguide Club Page Service is protected. Children and parents should pay special attention to the Privacy Section of this agreement.
YOURGUIDE CLUB PAGES AGREEMENT
Yourguide would like to provide you with an area to promote your organization, reach out to the community, and post news and ideas. Before creating a Yourguide Club Page ("Club Page(s)"), however, please review this Agreement carefully. All activity pertaining to your use of Yourguide's Club Page Service (the "Service") is governed by this Agreement, so you should read it carefully. Read the Conditions and Terms of Service and click on either the I Agree or the I Do Not Agree button at the bottom of the page. You may want to print this Agreement for easy reference in the future, and to distribute to those in your organization who may use the Service.
Any changes made to this Agreement will be announced on this page. Continued use of the Service by you will constitute your acceptance of any changes or revisions to this Agreement.
Yourguide does not discriminate based on sex, age, gender, sexual orientation, ethnicity, culture, religion or socio-economic status.
  1. Use of the Yourguide Club Page Service is available free of charge, exclusive of Internet access or other telecommunications fees, or other expenses you may incur.
  2. Non-profit, volunteer, and community groups based in Australia are eligible to use the Yourguide Build Your Own Club Page tool and to enter information into related directories.
  3. Organizations may have more than one Yourguide Club Page area if they wish to create sites for subgroups (i.e. a site for the local Y and a site for the afterschool program at the local Y), but they may not have more than one site per group or subgroup (i.e. you may not have two persons operating home pages for the same afterschool program).
  4. When you create a site, you will receive a user name and a password to that site and will control access to those pages. You must be authorized by your organization to participate in this program and you must have its permission to use its name. Yourguide assumes no responsibility/liability for any unauthorized use of this Service.
  5. The creation, maintenance, and content of all Yourguide Club Pages are the responsibility of those who create and post them. The opinions and views expressed on the club pages do not necessarily reflect those of Yourguide, and Yourguide does not endorse them.
  6. Users may submit any complaints that Yourguide Club Pages are in violation of this Agreement; please submit such complaints to manager.victortimes@ruralpress.com
  7. Yourguide reserves the right to post advertising in the form of banners or otherwise on the Club Pages, the content, location, size and rotation frequency of which shall be determined in Yourguide's sole discretion. You will not be entitled to receive any revenues collected by Yourguide for such advertising banners.
  8. You may not make any representation on the Club Pages or in any other materials in any form of media that Yourguide endorses the content within your Club Pages, or your organization, in any way whatsoever.
  9. Children are not allowed to disclose personally identifiable information (name, phone number, address, e-mail address, etc.) about themselves on the Club Pages.
  10. In consideration for your use of the service, you give Yourguide the right to use your name, or club pages, or portions thereof, for advertising, publicity and/or editorial purposes.
  11. When using the service, DO NOT:
    • display images or publish text that contain pornographic or sexually suggestive or explicit material of any kind;
    • use any obscene, indecent, or offensive language, including within your membership name or directory listing, or place on the Service any materials that are abusive, harassing, defamatory, libelous, hateful, racist or illegal;
    • promote or provide instructions or information about illegal activities or promote physical harm or injury against any individual or group;
    • commit any acts of infringement against any other party such as copyright, patent, trade-secret or any other intellectual property infringement. You further agree not to violate any third party privacy and proprietary rights;
    • offer links to pirated computer software programs, make available tools that can be used for no other purpose other than for "cracking" (i.e., removing copyright protection from software), or make available serial numbers for software which can be used to illegally validate or register software;
    • display materials not appropriate for or that exploits children;
    • display advertising/sponsorship banners of any kind;
    • promote or solicit for participation in multilevel marketing or pyramid schemes;
    • conduct or display information on illegal raffles, sweepstakes or contests of any kind or on any such activity that requires a fee to enter;
    • publish URLs and/or hyperlinks to other sites that violate the provisions of this Agreement; and
    • "spam" Internet users to promote your pages.
    • display material related to political campaigns for any candidate, proposition, initiative, etc.
  12. Yourguide may, but undertakes no obligation to, review the contents of the Club Pages. If you are in violation of this Agreement for any reason, or if your Club Pages are or become otherwise unacceptable as Yourguide may determine in its sole discretion, your Club Pages, or any portion thereof, may be removed without warning, and your access to the Service may be terminated.
  13. You agree that Yourguide is not responsible, and shall have no liability to you, with respect to any information or materials posted by others, including defamatory, offensive or illicit material.
  14. You agree to indemnify Yourguide and its affiliates, employees, agents and representatives, and to hold them harmless, from any and all claims and liabilities (including reasonable attorneys fees) which may arise from your Club Pages, from your unauthorized use of material obtained through the Service, from your breach or alleged breach of this Agreement, or from any such acts arising from your use of the Service.
  15. DISCLAIMER OF WARRANTY AND LIMITATION OF LIABILITY:

    YOU ACKNOWLEDGE THAT YOU ARE USING THE SERVICE AT YOUR OWN RISK. THE SERVICE IS PROVIDED "AS IS", AND YOURGUIDE AND ITS AFFILIATES HEREBY EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING BUT NOT LIMITED TO ANY WARRANTIES OF ACCURACY, RELIABILITY, TITLE, MERCHANTABILITY, NON INFRINGEMENT, FITNESS FOR A PARTICULAR PURPOSE OR ANY OTHER WARRANTY, CONDITION, GUARANTEE OR REPRESENTATION, WHETHER ORAL, IN WRITING OR IN ELECTRONIC FORM, INCLUDING BUT NOT LIMITED TO THE ACCURACY OR COMPLETENESS OF ANY INFORMATION CONTAINED THEREIN OR PROVIDED BY THE SERVICE. YOURGUIDE AND ITS AFFILIATES DO NOT REPRESENT OR WARRANT THAT ACCESS TO THE SERVICE WILL BE UNINTERRUPTED OR THAT THERE WILL BE NO FAILURES, ERRORS OR OMISSIONS OR LOSS OF TRANSMITTED INFORMATION, OR THAT NO VIRUSES WILL BE TRANSMITTED ON THE SERVICE.

    YOURGUIDE AND ITS AFFILIATES SHALL NOT BE LIABLE TO YOU OR ANY THIRD PARTIES FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ALLEGEDLY SUSTAINED ARISING OUT OF YOUR ACCESS TO OR INABILITY TO ACCESS THE SERVICE, INCLUDING FOR VIRUSES ALLEGED TO HAVE BEEN OBTAINED FROM THE SERVICE, YOUR USE OF OR RELIANCE ON THE SERVICE OR ANY OF THE INFORMATION OR MATERIALS AVAILABLE ON THE SERVICE, REGARDLESS OF THE TYPE OF CLAIM OR THE NATURE OF THE CAUSE OF ACTION, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

    SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
  16. You agree that this Agreement, for all purposes, shall be governed and construed in accordance with the laws of Australia applicable to contracts to be wholly performed therein, and any action based on or alleging a breach of this Agreement must be brought in a state or federal court in Australia. In addition, you agree to submit to the personal jurisdiction and venue of such courts.
  17. This Agreement is the complete and entire agreement between the parties governing the Service, and supersedes any prior agreement pertaining to the Service, whether written or oral.
About Privacy
This Service is maintained by Yourguide. We can be reached by e-mail at manager.victortimes@ruralpress.com. Please do not hesitate to contact us if you have any questions or concerns regarding privacy.
This Service expressly prohibits users from entering any children's personally identifiable information (names, addresses, e-mail addresses, phone numbers, fax numbers in the Contact Information section and on the Club Pages themselves. Contact Information will be published on the pages created by users. Contact Information should be entered for adults only.
Children: Be sure to ask your parents for permission before you send any information about yourself (your name, phone number, address, e-mail address, etc.) to us or anyone else over the Internet, and before making any purchases online. Do not enter any personally identifiable information about yourself in the Contact Information section or on the Club Pages themselves.
Parents: We encourage you to get involved with your children's online usage and to be aware of the activities in which they are participating. Any personally identifiable information collected by this service from children (that we are aware are children) will be used only for Yourguide's internal purposes and will not be provided to any third parties.
